Welcome to The Cosmic Fray. By accessing this website and purchasing our products, you agree to be bound by these Terms and Conditions. This site is owned and operated by Damian Smith / The Cosmic Fray.
2. Intellectual Property (The Most Important Part)
All content on this site, including but not limited to the “Cabinet of Curiosities” illustrations, Graphic Novel panels, text, and logos, is the exclusive property of The Cosmic Fray.
- No Unauthorized Use: Purchase of a print or digital wallpaper does not transfer copyright. You may not reproduce, resell, or distribute the artwork without a formal licensing agreement.
- Digital Downloads: Free or purchased digital wallpapers are for personal use only (e.g., phone/desktop backgrounds).
3. Print-on-Demand Fulfillment (Gelato)
Physical products (prints, shirts, mugs) are fulfilled by our partner, Gelato.
- Production Times: Orders are printed on demand. Estimated production and shipping times are provided at checkout but are not guaranteed.
- Shipping Address: The customer is responsible for providing a correct shipping address. We are not liable for items delivered to an incorrect address provided by the user.
4. Product Descriptions & Colors
We strive to represent our ink-work as accurately as possible. However, because computer monitors display colors differently and black ink depths can vary slightly on different materials (e.g., a matte print vs. a cotton shirt), we cannot guarantee an exact match.
5. Payments & Pricing
- All prices are in USD.
- We reserve the right to change prices or discontinue products at any time without notice.
- Payments are processed securely through [Shopify/Stripe/PayPal].
6. Email List & Digital Downloads
By providing your email address in exchange for a free digital download, you consent to receive marketing communications and updates regarding the Graphic Novel and Shop. You may opt-out at any time via the “Unsubscribe” link in any email.
7. Licensing Inquiries
Inquiries made through the “Licensing” page do not constitute a contract. A formal, signed Licensing Agreement is required before any commercial use of “The Cosmic Fray” assets is permitted.
8. Limitation of Liability
The Cosmic Fray is not liable for any indirect, incidental, or consequential damages resulting from the use of our website or the purchase of our products.
